The White House took a step on Monday to reject asylum for foreigners entering the United States through the southern border through Mexico. With the new regulations, the US government announced that it will prevent the granting of asylum to immigrants who do not request it before in a “safe third country”, in a new attempt to reduce the migratory flow on the border with Mexico, mainly from Central America.
“A foreigner who enters or intends to enter the US through the southern border after failing to apply for protection in a third country outside of their countries of citizenship, nationality or last habitual legal residence that has been en route to the United States. is not suitable for asylum, “said the new order published in the Federal Register and which will take effect on Tuesday.
The regulations, which were presented by the Department of Justice and the National Security Department, were announced on the same day that Guatemalan President Jimmy Morales was scheduled to meet with his US counterpart, Donald Trump, at the House. Blanca among rumors about the possibility of signing an agreement to make Guatemala a safe third country for migrants seeking asylum in the United States.
However, the Constitutional Court (CC) of Guatemala granted a provisional injunction on Sunday night so that Guatemala would not be converted into a safe third country for migrants.
In a statement, interim Secretary of Homeland Security, Kevin McAleenan, defended that this measure will ultimately reduce the “overwhelming burdens” on the national system “caused by asylum seekers who do not seek urgent protection in the first available country, migrants. that lack a legitimate fear of being persecuted. ”
US legislation allows asylum seekers to do so upon arrival at the border regardless of their route, but it has an exception for those who do so through a third country considered “safe”.
Currently, however, the US only has a specific agreement in this respect in which it recognizes Canada as the “third safe country”.
Trump, who arrived at the White House on January 2017 with the promise of a tough-on-hand immigration policy, has declared a national emergency due to the “humanitarian crisis” that, in his opinion, lies on the border with Mexico and has accused the countries of the Northern Triangle of Central America of not doing enough to stop the flow of migration.
A few weeks ago, it reached an agreement with the Government of the President of Mexico, Andrés Manuel López Obrador, to reinforce its southern border with Guatemala and to welcome asylum seekers in the United States. in the process of waiting.
The Government of Guatemala reported on Sunday that the meeting that was scheduled for Monday at the White House between Jimmy Morales and would be rescheduled.
However, the limitations, directed at those seeking to reach the United States from Mexico, will have three exceptions: foreigners who demonstrate that they applied for asylum in at least one country and their petition was ultimately denied who enter the definition of “victims of a serious form of human trafficking” and those who have traveled on their way to the United States from countries that are not part of the 1951 Refugee Convention or the 1965 Protocol.
